By creating an account on nyc-rides.bike or using the platform in any way, you agree to these terms. If you don't agree, don't use the platform.
nyc-rides.bike is operated by Pubcz LLC, a New York limited liability company ("we," "us," "the platform"). These terms are a legal agreement between you and Pubcz LLC.
What This Platform Is
nyc-rides.bike is a platform where cycling clubs and individuals can post and find group rides in New York City. We provide the technology — clubs and riders provide everything else. We do not organize, lead, vet, or supervise any ride listed on this platform.
Cycling clubs listed on nyc-rides.bike are independent organizations and are not operated by Pubcz LLC. Clubs may require their own membership agreements, waivers, or codes of conduct, which are between you and that club. Accepting these platform terms does not substitute for any club's own requirements, and joining a club does not substitute for these terms.
Your Responsibilities
- You must be at least 18 years old to use this platform.
- You must provide accurate information in your account.
- You must follow our Code of Conduct.
- You are responsible for keeping your login credentials secure.
- You must not use the platform for anything illegal, for commercial solicitation, or in any way that interferes with other users or the platform's operation.
Assumption of Risk & Waiver
This is the most important section. Please read it carefully.
Cycling is inherently dangerous. Riding on public roads, in traffic, in groups, and in varying weather and road conditions carries real risk of serious injury or death.
By using this platform, you acknowledge and agree that:
- You voluntarily assume all risks associated with cycling and with participating in any ride found through this platform, including the risk of serious bodily injury, permanent disability, or death.
- The platform does not screen, vet, or verify ride organizers, ride leaders, other participants, clubs, routes, road conditions, weather conditions, or any other aspect of any ride.
- The platform makes no representation that any ride is safe or appropriate for any rider.
- You are solely responsible for evaluating whether a ride is appropriate for your skill level, fitness, and equipment.
You waive and release Pubcz LLC, its members, officers, agents, and affiliates from any and all claims, demands, and causes of action arising from your use of this platform or participation in any ride found through it, including claims for personal injury, death, or property damage, whether caused by negligence or otherwise.
You further agree to indemnify and hold harmless Pubcz LLC from any claims, liabilities, or expenses (including legal fees) arising from your use of the platform, rides you organize or participate in, or content you post.
Content & Moderation
You own the content you post on nyc-rides.bike (ride listings, descriptions, comments, profile information). By posting content, you grant Pubcz LLC a perpetual, worldwide, royalty-free license to display, distribute, modify, and use that content for platform operation and promotional purposes.
You are responsible for your content. Don't post anything you don't have the right to share.
We may remove any content and suspend or terminate any account at our sole discretion, for any reason, with or without notice.
Legal
Disclaimer of warranties. This platform is provided "as is" with no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or availability.
Limitation of liability. Pubcz LLC's total liability to you for any claim arising from your use of this platform is $0. This is a free platform. In no event will we be liable for any indirect, incidental, consequential, or punitive damages.
Governing law. These terms are governed by the laws of the State of New York.
Dispute resolution. Any dispute arising from these terms or your use of the platform will be resolved through binding arbitration administered by JAMS under its rules, held in New York, NY. You may instead bring a claim in small claims court if it qualifies. You agree to resolve disputes with us individually and waive any right to participate in a class action, class arbitration, or representative proceeding. Any claim must be brought within one year of the event giving rise to it.
Severability. If any part of these terms is found unenforceable, the rest remains in effect.
Changes. We may update these terms. Continued use of the platform after changes constitutes acceptance.
Privacy. Our collection and use of your data is described in our Privacy Policy.
